Scottish Defend Our Juries Campaign Update

Dear friends,
The way Defend Our Juries placard holders have been treated in Scotland has been a bit different to in England. There have been no arrests during the protests but police have visited people at home days or weeks later to arrest and charge people with s.13 of The Terrorism Act 2000. As the Scottish legal system is different there is an opportunity to challenge these prosecutions through the criminal court before any trial by having a ‘Diet of Debate’ to thrash out the legal issues. This is separate to Huda Ammori’s Judicial Review in England and Craig Murray’s Judicial Review in Scotland. There is a procedural hearing on 9th July where the Advocate General acting on behalf of the UK Government will try to delay the debate. We are hoping that the Scottish judiciary will stand up to this and an eventual win here could have ramifications for those facing prosecution in England.
The Scottish context of both how the genocide in Gaza is acknowledged here and the long history of nonviolent direct action (including the many Trident Ploughshares actions at Faslane and Coulport) will inform the legal process.

There are good lawyers involved – but unfortunately none that act for free.
If you can chip in a bit towards legal costs to grab this opportunity to come at this from a different angle the DOJ team in Scotland would really appreciate it. See below.

love Jane
(I’ve not been taking action with DOJ but have been using my experience of the Scottish courts with TP to help with understanding – or trying to – the legal process

Scotland – Support Peaceful Signholders

There is NO REASON why SCOTLAND should follow suit with England in oppression of human rights.  Political context and police behaviour differ from those down south and we are hopeful that legal decisions will also demonstrate similar independent thought.

On Thursday July 9, Defend Our Juries arrestees in Scotland have their first hearing in the High Court via a pre-trial option for criminal cases available in Scotland called a Diet of Debate. This will be a test case challenging all our arrests under the Terrorism Act, arguing that this breached our human rights.

This first hearing in the High Court is ‘procedural’ but important. It will decide when and how we proceed to the Diet of Debate.

Unfortunately, every procedure is costly, a factor those seeking to criminalise democratic protest are no doubt keeping their fingers crossed will price us out. Let’s prove them wrong.
