The ICJ case on Climate Change : How to influence the Hearings

Dear Peter, 

On April 20, 2023, the ICJ announced receipt of a request by the UN General Assembly to render an Advisory Opinion on the climate issue.

The ICJ has sent an invitation to all UN member states to provide written comments(submissions) on the legal questions the Court will consider, notably:

  • What are the obligations of States under international law to ensure the protection of the climate system and other parts of the environment from anthropogenic emissions of greenhouse gases for States and for present and future generations;
     
  • What are the legal consequences under these obligations for States where they, by their acts and omissions, have caused significant harm to the climate system and other parts of the environment, with respect to:

    (i) States, including, in particular, small island developing States, which due to their geographical circumstances and level of development, are injured or specially affected by or are particularly vulnerable to the adverse effects of climate change?

    (ii) Peoples and individuals of the present and future generations affected by the adverse effects of climate change?
Join us on May 22 to learn about the Advisory Opinion process and how to get strong submissions to the Court from like-minded states, to help ensure a successful outcome to the case.The campaign to take climate change to the ICJ was initiated by Pacific Island Students Fighting Climate Change, advanced globally by World ‘s Youth for Climate Justice and led in the UN General Assembly by Vanuatu and 17 other core countries.

The May 22 event is organised by Normandy Chair for Peace and World’s Youth for Climate Justice.
